Terms & Conditions
All equipment hired from CONTRALLUM RENTAL is subject to the following clauses. By hiring from CONTRALLUM RENTAL, the client is understood to know and have accepted the following terms and conditions.
1. GENERAL ASPECTS
We recommend reading the following general hiring conditions carefully, as they apply to all rentals contracted with CONTRALLUM RENTAL and take effect immediately after signing the contracted quote. The rental contract is formalized with the client's acceptance of the equipment at the time of delivery. The person collecting the equipment will sign the "delivery note" accepting our general conditions. In all cases, CONTRALLUM RENTAL will consider that the person to whom the equipment is delivered and who signs the contract has been duly authorized to carry out this action on behalf of the contracting party.
2. OWNERSHIP OF EQUIPMENT
The equipment is owned by CONTRALLUM RENTAL or made available by third parties and is under its custody and responsibility. Sub-letting of equipment hired from CONTRALLUM RENTAL is prohibited unless specific prior written authorization is given.
3. RESPONSIBILITIES ASSUMED BY THE CLIENT
By signing the contract, the client acknowledges having checked that the equipment is in good working order and in good technical and cosmetic condition, and having verified that all requested material has been made available. No claim will be accepted once the equipment has left our premises. The client undertakes to safeguard the hired equipment diligently and professionally. The client undertakes to protect the equipment from weather conditions and to take all necessary precautions for its preservation and security. The client will be liable to CONTRALLUM RENTAL for all damage that may occur while the equipment is under their responsibility, i.e. from when the client collects the equipment until all hired equipment has been returned. The client must avoid placing the hired equipment in any situation that risks damage or loss. In addition, the client undertakes to inform CONTRALLUM RENTAL in advance and to request its express acceptance if the equipment is to be used for any high-risk recording (underwater, aerial, vehicle-mounted recordings, and any similar situation). Therefore, CONTRALLUM RENTAL reserves the right to change rental conditions, including refusing such uses and canceling the contract. The client undertakes not to alter, dismantle, transform, amend, or perform any similar action on the hired equipment. The client may only entrust operation of the equipment to competent technicians who know how the hired equipment works. CONTRALLUM RENTAL assumes no training obligation and the client will be responsible for damage related to misuse. Costs related to damage or loss of equipment, theft or robbery, and/or immobilization of equipment in customs will be borne by the client. In the event of any incident such as those indicated above, compensation is the client's responsibility and will be based on the replacement cost of new equipment at the value on the date of the incident.
4. COLLECTION AND VERIFICATION OF EQUIPMENT
The client must personally arrange (assigning a technician or competent person) for verification of all contracted equipment and ensure that all material requested in the quote has been made available. Once this check has been carried out, the contract is signed. From that moment, the equipment is the client's responsibility and CONTRALLUM RENTAL is released from all responsibility regarding the condition and quantity of equipment made available to the client.
CONTRALLUM RENTAL offers a transport service, both for delivery and collection of equipment, the price and conditions of which will be stipulated in the rental quote.
5. SECURITY RULES
To collect contracted equipment, every client, or failing that, the contracted carrier, must identify themselves by national ID (DNI), foreigner ID (NIE), or passport. No other document will be valid. For security reasons, said document will be scanned and kept with the commercial transaction documentation in accordance with data protection regulations. After the period stipulated by applicable law, the documentation will be destroyed.
6. WARRANTY
In the event of a breakdown of any equipment, the client must immediately notify CONTRALLUM RENTAL and take or send said equipment to its premises. If a breakdown is confirmed, CONTRALLUM RENTAL undertakes to offer a replacement for the equipment in question if available. If CONTRALLUM RENTAL technicians find that there is no breakdown or that malfunction was the result of misuse, the client will be charged the price of the replacement equipment. For urgency reasons and considering transport time, the client may request delivery of replacement equipment before returning the allegedly faulty equipment. If CONTRALLUM RENTAL technicians find no breakdown, the client will be invoiced for both pieces of equipment. Under no circumstances will CONTRALLUM RENTAL be responsible for covering transport costs due to breakdowns; these will be borne by the client. In the event of theft or robbery with or without violence of equipment hired from CONTRALLUM RENTAL during the contracted rental period, responsibility for replacing such materials in the same condition they were in, or assuming the cost of replacement, will always lie with the client or the insurance they have contracted.
7. INSURANCE
CONTRALLUM RENTAL does not include insurance that covers the equipment in any respect during the rental period. Our recommendation is that the client take out personal insurance for the equipment in question, providing a certificate showing that the insured value is equal to or greater than the equipment offered for hire by CONTRALLUM RENTAL. In most insurance policies in Spain, the following damage is EXPRESSLY EXCLUDED from coverage: fraud/non-return, theft of equipment (adequate surveillance in parking areas is important), losses, damage, or expenses attributable to willful or negligent conduct.
8. OBLIGATIONS ON USE OF EQUIPMENT
The client undertakes to use the hired equipment exclusively for the purposes for which it was designed and hired. Use of the equipment for illegal, dangerous, or unauthorized activities that may compromise its integrity or compliance with current regulations is strictly prohibited.
The client undertakes to:
- Respect usage instructions and technical limitations specified by CONTRALLUM RENTAL.
- Notify any incident in the condition of the equipment immediately after detecting it.
- Not allow unqualified persons or persons outside the contract to operate the hired equipment.
Any breach of these conditions will result in financial penalties and, where appropriate, the initiation of legal action.
9. RETURN OF EQUIPMENT
The client undertakes to return the hired equipment in the same condition in which it was delivered, both in technical and cosmetic state, and within the period established in the contract.
Return must be made at CONTRALLUM RENTAL premises unless prior written agreement is made for another location. Late return of equipment will result in penalties:
- If the delay exceeds 12 hours, a full day of the rental price will be charged.
- If the delay is less than 12 hours, only the proportional part of the excess hours will be charged.
- If the client is known or a regular customer and suffers a delay, CONTRALLUM RENTAL will assess the case and may apply flexibility in penalties.
After a maximum period of 15 days, CONTRALLUM RENTAL may consider the equipment lost and demand full replacement.
If damage, losses, or missing components are detected upon return, the client will be responsible for repair, replacement, or any other costs arising from such incidents.
10. CANCELLATIONS AND CONTRACT MODIFICATIONS
The client may request cancellation or modification of a rental contract by notifying at least 48 hours before the start of the rental period.
In the event of cancellation within the 48 hours prior to the start of the rental, a penalty equivalent to 50% of the total rental cost will apply. If cancellation is made less than 24 hours in advance, 100% of the total rental cost will be charged.
Any requested modification will be subject to equipment availability and must be confirmed in writing by CONTRALLUM RENTAL.
11. FORCE MAJEURE
CONTRALLUM RENTAL will not be responsible for inability to fulfill contractual obligations due to force majeure events, such as natural disasters, power supply interruptions, strikes, armed conflicts, or any other circumstance beyond its reasonable control.
In such cases, CONTRALLUM RENTAL may choose to temporarily suspend the contract or terminate it without penalty for either party.
12. CONFIDENTIALITY AND DATA PROTECTION
All data provided by the client will be processed in accordance with the Organic Law on Data Protection (LOPD) and the General Data Protection Regulation (GDPR).
CONTRALLUM RENTAL guarantees confidentiality of the information provided and its exclusive use for purposes related to the rental contract. The client may exercise their rights of access, rectification, erasure, and objection by sending a written request to CONTRALLUM RENTAL's address.
13. PRICES AND PAYMENT METHOD
You can check equipment prices on the Contrallum Rental website. However, when hiring numerous items, we work with quotes that include discounts and price adjustments. Audiovisual equipment rental prices vary depending on project duration and the number of items hired.
Payments can be made in cash or by bank transfer to the account number shown on the quote or invoice. The natural or legal person making payment will be the contracting party for the services. This condition will be fully mandatory.
If the booking is made more than one week in advance, 50% of the total price will be paid, and the remaining 50% will be paid before collection of the equipment. If the period is less than one week, 100% must be paid to confirm the booking.
14. SPECIFIC CONDITIONS FOR EXCEPTIONAL USES
The client must inform CONTRALLUM RENTAL in writing and in advance if the hired equipment will be used in situations that may compromise its integrity or operation, such as:
- Recordings in extreme environments (high or low temperatures, humidity, dust, etc.).
- Use in aerial recordings via drones or helicopters.
- Underwater recordings or contact with water.
- Recordings in moving vehicles or on unstable platforms.
In these cases, CONTRALLUM RENTAL reserves the right to apply additional conditions, request specific guarantees, or deny use of the equipment in such environments.
15. RESPONSIBLE USE POLICY
The client undertakes to use the hired equipment responsibly and professionally, always respecting current legal regulations on safety and intellectual property rights.
Use of the hired equipment for illegal, immoral activities, or activities that may put third parties at risk is prohibited. CONTRALLUM RENTAL reserves the right to terminate the rental contract immediately if a breach of this clause is detected, without prejudice to any legal action that may arise.
16. CLAIMS
Any claim related to the rental contract must be notified in writing to CONTRALLUM RENTAL within a maximum period of 7 calendar days from the end of the rental period.
Claims submitted outside this period will not be accepted. CONTRALLUM RENTAL undertakes to resolve any claim fairly and as quickly as possible, in accordance with the conditions established in the contract.
17. SEVERABILITY CLAUSE
If any provision of these terms and conditions is considered invalid or unenforceable by a competent court, said provision will be removed or modified to the extent necessary, without affecting the validity and enforceability of the remaining clauses.
18. CLIENT ACCEPTANCE
For equipment to be considered reserved, the quote presented by CONTRALLUM RENTAL must have been accepted and signed by the client.
The client acknowledges having read and understood these general rental conditions and agrees to comply with them in full when signing the rental contract or when collecting the equipment.
Any exception or modification to these conditions must be agreed in writing and signed by both parties.
19. JURISDICTION AND APPLICABLE LAW
This contract shall be governed by and interpreted in accordance with the laws of Spain. Any dispute arising in relation to this contract shall be submitted to the jurisdiction of the courts of the city of Valencia, with the parties expressly waiving any other jurisdiction that may correspond to them.
In accordance with Organic Law 3/2018 of 5 December on Personal Data Protection and guarantee of digital rights and its complementary regulations, CONTRALLUM RENTAL informs you that the personal data provided will be incorporated into a file under its responsibility for the purpose of service management and the contractual relationship. Respecting current legislation, CONTRALLUM RENTAL undertakes to adopt the necessary technical and organizational measures, according to the level of security appropriate to the risk of the data collected.
Data protection regulations allow you to exercise your rights of access, rectification, objection, erasure, restriction of processing, portability, and not to be subject to automated individual decisions against the data controller.
